I,____________________ , hereby agree to adequately control vegetation
(per current County Weed list) growing within the Stevens County road right-of-way, adjoining my
property, in lieu of herbicide applications by County personnel.
Determination of "adequate control" is at the sole discretion
of Weed Board personnel, but will normally mean that the listed noxious
weeds are not producing seed.
I further agree to post "OWNER WILL MAINTAIN" signs
and "END OWNER MAINTAINED" signs provided to me by
Stevens County at the area described below in the manner prescribed by
Stevens County in the provided "posting instructions". The
signs remain the property of the County.
I further agree to periodically inspect the sign placements for
assurance that they are in place from April 1 to October 31 of each
year. I understand it is my responsibility to replace or repair signs as
necessary to ensure they are legible and visible.
I further agree that the County has the right to treat the described
areas with herbicide, without prior notice, if the signs are not in
place, readable and visible. I understand proper sign placement is
my sole responsibility.
I further agree that failure on my part to adequately control
vegetation listed can result in a "Notice of Termination of
Agreement" being issued by the Weed Board. Such notice of
termination will be effective seven days following mailing to the
property owner at the address listed below. Following termination the
county may implement control by any method it deems appropriate. I also
agree that actual current year control costs expended by the County for
listed weeds on the described area may be billed to me and I am
responsible for payment if the agreement is terminated under the
provisions of this paragraph.
I agree to all of the terms and conditions set forth in this
contract. I have been provided and have read and/or had explained to me
the current "Stevens County Weed List" and "Posting
Instructions".
This agreement is valid until or unless notification of termination,
in writing, by either the County or the Owner is issued. Written notice
from owner must be received before April 1 of any given year to avoid
responsibility for current year control costs. This agreement is not
transferable.
